Winboard is an online marketplace which facilitates the delivery and execution of hyper-localised and targeted advertising using vacant or underutilised assets. In order to provide our services to you it is necessary that we obtain some personal information about you.

This Privacy Policy sets out how Winboard Holdings Pty Ltd (‘Winboard’, ‘we’, ‘our’ or ‘us’) collects, holds, uses, discloses and manages that information.  If through using our website or services you disclose personal information to a third party website, this policy will not apply as between you and the third party and you will be subject to the privacy policy of that third party.

Words defined in the Winboard Terms and Conditions have the same meaning in this Privacy Policy.

By accessing or using our services you agree to the collection, holding, use and disclosure of your personal information in the manner described in this Privacy Policy.

Keeping your information private

How does Winboard protect my privacy?

Winboard respects the importance of and is committed to protecting your privacy when managing your personal information.

What personal information about me is collected?

Personal information collected by Winboard will depend on the circumstances of collection and on the services that we are providing to you and may include:

identification details, which may include name, address, birth date, gender, security questions and answers;

contact information which may include email address and mobile phone number;

bank account and credit account details;

user IDs and passwords;

business information, such as ABN and licence number;

information submitted in the process of placing an advertisement in respect of an asset, for example company details, property or asset location and pricing;

your IP address, information about the devices on which you visit the Winboard website, and your activities on those devices or the Winboard site (including browser and operating system, time, date, referral information, location, carrier and site interactions);

records and content of communications with Winboard;

if you are applying for employment with us, personal information that is relevant to such employment;

information obtained as a result of your use of our mobile website or application such as geo-locations and unique device identifiers; and

if you access any of our services through a social network or login to our websites using your social network credentials such as Facebook, we may collect limited information provided to us by that social network site, such as user name, site ID, profile photo and email address.

Please note that any records and content provided in hard copy format may be stored and scanned electronically by Winboard.

Winboard does not collect and hold sensitive information as defined in the Privacy Act 1988 (Cth), such as racial or ethnicity information, political opinions or associations, criminal records (save where provided by law enforcement authorities) or health information. However, subject to obtaining your prior consent, Winboard may collect and hold sensitive information from you in the course of considering an application for employment.

How is my personal information collected and held?

Winboard collects and holds personal information in a number of ways, including:

directly from you when you provide information directly to us in person, by phone or in writing (whether electronic or otherwise), for example when you register to use our Platform, seek an advertisement space on our Platform, enquire about a Listing or place a Listing on our website;

from third party data providers and other entities where you have directed or otherwise consented to the collecting entity (or a service provider on its behalf) sending us data; or

directly from you when applying for an employment opportunity with us via a social networking site (eg. LinkedIn) or through your nominal referees. 

We may also collect and hold your personal information through our service providers and third parties so that we may provide a better service or product to you.

Winboard may also collect and hold personal information about you if you are a Winboard shareholder. This information will be collected from you directly.

How is my personal information used?

Winboard will use the personal information it collects and holds for the purpose for which you provided it, the purposes disclosed in this Privacy Policy, any related secondary purposes which you would reasonably expect and for any other purpose you have consented to.

More specifically, your personal information may be used for purposes including:

to maintain appropriate business records or manage our relationship with you;

to research, develop, improve and use within Winboard products and services;

to respond to an enquiry or provide our services, products or assistance that you request from us;

to pre-populate / customise / provide shortcuts on our Platform;

to conduct surveys to determine use and satisfaction with Winboard services;

for the purposes of feedback, reviews and ratings;

to promote and market special offers and other services to you (if you do not want to receive these, please let us know by using the unsubscribe facility in a direct marketing communication sent to you);

for purposes connected with the operation of Winboard;

for staff training and quality assurance; and

to combine your personal information that we have collected from our service providers, third parties or cookies in order to provide you with a better or more relevant and personalised experience and to improve the quality of our services and the services of third parties.

How is my personal information shared?

Winboard may disclose personal information to individuals and organisations other than Winboard. The organisations to which we may disclose personal information include:

the public and people seeking an advertisement space if you advertise with Winboard;

land and other asset owners if you are seeking an advertisement space on or in their asset;

outsourced service providers who assist Winboard to provide its services including: information technology providers; marketing and market research advisers and survey providers; professional advisers; and payment platforms;

entities to whom you request we send your information;

to assist government or regulatory authorities or police; and

as we are required by law, for example pursuant to a subpoena or in accordance with unclaimed money legislation.

Where Winboard provides information to a third party at your request, you acknowledge that your information will be handled by that third party in accordance with its privacy policy and not in accordance with this Privacy Policy. We are not responsible for the way these organisations collect, hold, use, disclose or handle personal information you provide to them through our website.

Where Winboard discloses your personal information to a data service provider, Winboard will take all reasonable steps to ensure those data service providers comply at all times with the Privacy Act and the APPs.

How do I keep my personal information up to date?

Winboard strives to maintain accurate and up-to-date records. To facilitate this, please let us know if any of your details change. You may update certain personal information through your registered account on the Platform (if you have one) or by contacting us by email (see paragraph 2.15 below).

Winboard may destroy or de-identify personal information once the information is no longer deemed required by the business.

How do I access my information?

You generally have a right to access your personal information, subject to a few exceptions provided by law. If you wish to access your personal information please contact us by email (see paragraph 2.15 below). Please remember to provide as much detail as you can as this will help us to find the information. Generally, there will be no charge for this service, however, you may be required to verify your identity before any information is released to you. Depending on the volume, type or method of access to the information you request, Winboard may charge you some fees, however, these will not be excessive and will not apply to the making of the request. Please note that depending on the volume or nature of the information required, it may take a number of days to fulfil the request.

1.8           How is my information protected?

Winboard takes reasonable steps to protect personal information collected from misuse, loss, unauthorised access, modifications or disclosure. Your personal information may be stored in hard copy documents, but is generally stored electronically on the Winboard systems. Our employees, contractors, agents and service providers who provide services related to our information systems, are obliged to respect the confidentiality of any personal information held by us. We review and update our security measures in light of current technologies. Unfortunately, no data transmission over the internet can be guaranteed to be totally secure.

1.9           Is my personal information shared outside of Australia?

Winboard may store or process your personal information on a server located outside this country where you live and may be accessed by or given to our staff working outside Australia and third parties who act for us for the purposes set out in this Policy.  The third parties with whom we share your information may undertake various activities such as processing credit card payments and providing support services for us.  By providing us with personal information, you consent to the disclosure of your personal information to third parties who reside outside Australia. 

1.10        Can I deal with Winboard anonymously?

You may deal with Winboard anonymously by using a pseudonym, unless Winboard is required or authorised by law to deal only with an identified person, or it is impracticable for us to respond to you if you have not identified yourself.

1.11        What if I choose not to provide my personal information?

If you choose not to provide personal information when requested, Winboard may not be able to provide you with the full range of Winboard services.

1.12        Is my location collected?

When accessing the Winboard website from a mobile device, we may request permission to collect your location from your device via the permission system used by your mobile operating system. If you consent to the collection of this information, you can later disable it by changing the location settings on your mobile device. However, this may limit your ability to use certain features of our services.

1.13        How does the Winboard website record my activity and use it?

Third party websites

Where the Winboard website provides links to third party websites, the operators of such sites may collect personal information through the use of cookies and otherwise. Winboard is not responsible for linked third party sites and recommends you read the privacy policy of such sites before disclosing your personal information.

 

 

Cookies

We may use cookies, web beacons and measurement software and tools on our Platform. A “cookie is a small text file that a website sends to your computer, tablet or mobile phone to uniquely identify or store information in your browser. “Web beacons” are bits of data that count the number of users who access a website and track how they use the website.  

We use and disclose the information collected through the use of cookies, web beacons and measurement software and tools in accordance with this Privacy Policy. Winboard may use cookies for the following purposes:

(1)            Functional – to perform helpful functions on the Winboard website. For example, if you have searched our Platform for an advertising opportunity in the Melbourne CBD, cookies will enable us to show you advertising spaces in nearby suburbs, rather than locations that may be of less interest to you.

(2)            Authentication – to allow Winboard to “remember” that you logged in as a member and provide you with member only functions.

(3)            Analytical – to allow Winboard to analyse user behaviour on an aggregate and anonymised level so that we can improve the site.

(4)            Advertising – to allow Winboard and third party advertisers to track your browsing behaviour across the site and serve advertising based on that behaviour.

(5)            Marketing – to allow Winboard to adjust its marketing strategies to user interests and to report on success of campaigns.

Further purposes include using the information to report statistics, analyse trends, administer our services, diagnose problems and target and improve the quality of our products and services.

We may combine our cookies, information collected through the cookies and web beacons on our website with other information and use analytics services to provide better or more relevant services to you on our website.

If you do not want information collected through the use of cookies, web beacons or measurement software and tools, you may be able to delete or reject cookies or some of the measurement software features through your browser or the settings section of your mobile or tablet device. Disabling these features may cause some of the functions on our website, or our services, to not properly work.

Please note that Winboard is permitted to retain certain personal information for the purposes notified to you under this policy, including, for example, to maintain appropriate business records. 

Winboard treats complaints relating to privacy extremely seriously. If you submit a concern or complaint, we will endeavour to deal with it comprehensively and reach an outcome with which all parties are satisfied. If you are not satisfied with our response to your complaint (after providing us with a reasonable time to respond) or would like further information about privacy in Australia, then we suggest you contact the Office of the Australian Information Commissioner’s website.
